APPENDIX C – ADVERTISING REQUIREMENTS AND PROCEDURES FOR AFFILIATE COMPLIANCE IN SWEDEN

Set out below are specific requirements that apply to all Affiliate Marketing in Sweden. It is essential that Affiliates are familiar and fully compliant with the requirements below.  Any breaches of these requirements shall be a material breach and shall give the Company the right to terminate the Agreement with immediate effect.

1. Bonuses and financial incentives

It is not permitted to offer players bonuses or financial incentives directly linked to gambling other than on the first occasion when a player plays with the licensed operator in Sweden.  The Swedish Regulator has confirmed that license holders are responsible for any marketing carried out by third parties for its behalf.  Affiliates are not permitted, therefore, pursuant to this Agreement to offer on behalf of the Company directly or otherwise any bonuses or financial incentives (including but not limited to money, gifts, trips, free spins, free games/bets etc) or to run competitions, tournaments or other programmes, which purpose is to ‘reward’ or incentives players to register accounts or playing on the Company’s brand(s).

2. Moderate marketing

• Marketing must be moderate. Please read BOS and SPERS’s Marketing Guidelines: http://www.bos.nu/wp-content/uploads/2019/03/BOS-and-SPER-Marketing-Guidelines-2.1.pdf
• Konsumentverket has indicated that it will not regard the following to be moderate:
  • Exaggerating the chances of winning when that is not the case;
  • Encouraging excessive gambling;
  • Suggesting that playing is free or risk-free;
  • Suggesting that the playing or gambling can resolve financial problems;
  • Take-over adverts will be regarded as intrusive and not moderate.

3. Direct mail / email marketing

Direct mail and/or email marketing by Affiliates is not permitted in Sweden.

4. Information obligation

• All marketing and commercial communication concerning gambling MUST include clear information regarding the minimum age to gamble.
• All marketing and commercial communication MUST contain contact information for Stödlinjen – www.stodlinjen.se – and should also contain the wording “Spela Ansvarsfullt”.

5. Unfair marketing

• Marketing which does not contain the required information (as set out in point 3 above) will be unfair to consumers and in violation of the Marketing Act (2008:486).
• If the required information (as set out in point 3 above) is not provided, the Marketing Act shall apply, and the information shall be regarded as material in accordance with the third paragraph of § 10 of the Marketing Act.

6. Bank-ID and Swish

The use of Bank ID or Swish trademark (i.e. both logo and word mark) is not permitted in any advertising format by affiliates.
